Kentucky is known for its beautiful landscapes and delicious bourbon, but it also has strict laws when it comes to driving under the influence (DUI) of drugs or alcohol. One of the consequences of a DUI conviction in Kentucky is license suspension. Navigating these suspensions is one of the many reasons why you should contact a reputable DUI defense attorney.

If you are arrested for a DUI in Kentucky, you will face two separate cases: a criminal case and an administrative case with the Kentucky Transportation Cabinet. The administrative case involves the suspension of your driver's license, and it is separate from any criminal penalties you may face.

LICENSE SUSPENSION LENGTHS

The length of the license suspension will depend on the number of previous DUI convictions and the level of intoxication at the time of arrest. If this is your first offense, your license will be suspended for 4 to 6 months.

For a second offense within 10 years, your license will be suspended for 18 months. A third offense within 10 years will result in a license suspension for 36. Fourth and subsequent offenses within 10 years are considered felony offenses, and your license will be suspended for up to 60 months.

While the law used to allow for a hardship license during the suspension period, the only option under current law is to apply for an ignition interlock license. Applying for an IIL may allow you to shorten your suspension period. The ignition interlock license allows you to have an ignition interlock device installed in your vehicle. This device requires you to blow into a breathalyzer before starting your car and at random intervals while driving to ensure that you are not driving under the influence.

If you are a commercial driver, the legal limit for blood alcohol content (BAC) is lower than the standard legal limit. If you are caught driving a commercial vehicle with a BAC of 0.04% or higher, your commercial driver's license will be suspended for a year. A second offense will result in a lifetime ban on commercial driving.

It's important to note that if you are convicted of a DUI in Kentucky, you will also face criminal penalties. These can include fines, jail time, community service, and mandatory alcohol and drug treatment programs.

In summary, DUI convictions in Kentucky result in license suspension, which can range from 6 months to 5 years depending on the number of offenses and level of intoxication. Reinstating your license requires completing a mandatory program and installing an ignition interlock device. It's important to take DUI charges seriously and seek legal help if you find yourself facing charges.
